Terms of Service

These Terms of Service govern your use of the Leav platform, including getleav.com and the Leav mobile self-checkout service (together, the "Service"), operated by Leav Inc. ("the Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. Nothing in these Terms limits statutory rights that apply under the laws of your country of residence.
1. Agreement
These Terms govern your use of getleav.com and the Leav checkout service operated by Leav Inc. (417 Rue Saint-Pierre, Suite 200, Montreal, QC H2Y 1C6, Canada). By creating an account or using the Service you accept these Terms. Merchants who integrate Leav with their Shopify store additionally agree to be bound by any Merchant-specific addendum we provide at the time of onboarding. Nothing in these Terms limits your statutory rights under the laws of your country of residence.
2. Use of the Service
Leav is a B2B SaaS product. Merchant access is granted through paid subscription accounts. Shopper access to a store's checkout link is granted by the merchant. When using the Service you agree to the following:
- You must be of legal age in your jurisdiction, or have parental or guardian consent, to enter into these Terms.
- You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to any part of the platform or its infrastructure.
- You may not scrape, reverse-engineer, disassemble, or copy any part of the Service except as expressly permitted by mandatory law.
- Merchants are responsible for ensuring their use of Leav, including the collection of shopper data through their stores, complies with applicable privacy and consumer-protection laws.
3. Intellectual Property
The Service, including its underlying software, algorithms, trademarks, and visual design, is owned by the Company or its licensors and is protected by Canadian and international intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service solely for its intended purpose under these Terms. No other rights are granted.
4. Merchant Data and Shopper Data
Merchants are responsible for any business data and content they submit through the Service, including their Shopify product catalog and store configuration. Merchants grant us a limited licence to use, store, and process that data to provide the Service. You represent that you have the necessary rights to submit any data you provide.
Shopper checkout session data (scanned items, cart totals, payment confirmation references) is processed on behalf of the merchant. Our Privacy Policy describes how personal information is handled.
5. Subscription, Billing, and Trial
Access to the Leav merchant platform requires a paid subscription at the tier you select. We offer a 14-day free trial on Starter and Growth plans with no credit card required. After the trial, you will be billed at the applicable subscription rate. Subscriptions renew automatically unless cancelled before the next billing cycle. You may cancel at any time through your account settings.
6. Disclaimers
The Service is provided on an "as is" and "as available" basis. The Company disclaims all warranties to the maximum extent permitted by applicable law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free. Mandatory consumer warranties applicable in your country of residence are not affected by this disclaimer.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Service will not exceed the amount you paid to the Company in the 12 months immediately preceding the claim, or CAD 100, whichever is greater. This limit applies whether the claim sounds in contract, tort, statute, or any other theory. Liability that cannot be limited under mandatory law is not affected.
8. Indemnification
You agree to indemnify and hold harmless the Company, its directors, employees, and contractors from and against any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party right.
9. Termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, or conduct that causes harm to the Service or other users. You may terminate your account at any time by cancelling your subscription. Sections 3, 6, 7, 8, 10, and 11 will survive termination of these Terms.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Canada, including federal law and the laws of the Province of Quebec, without regard to conflict-of-law principles.
Disputes arising from or related to these Terms are subject to the non-exclusive jurisdiction of the competent courts located in Montreal, Canada, without prejudice to mandatory consumer-protection rights of your country of residence. Nothing in this section prevents you from seeking relief before any court that has mandatory jurisdiction over a dispute involving your statutory rights.
11. Changes and Contact
We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date. If you continue using the Service after changes take effect, you accept the revised Terms. For questions about these Terms, contact us at:
